Multiple states signed on to a letter to the EPA in which they announced an intent to sue unless the EPA (1) determined whether standards of performance were appropriate for methane emissions from oil and gas sources; and (2) issued emissions guidelines for methane emissions from existing oil and gas sources. The letter asserted that the EPA had failed make required determinations about methane when updating its standards for the oil and gas industry under Clean Air Act § 111. In 2016, the EPA announced the first-ever such standards.
