- Summary:
- The Secretary of State, in consultation with the president of NYSERDA, must adopt regulations to establish energy efficiency performance standards, testing procedures, and procedures to certify manufacturing for certain products and appliances.
- Status:
- In Progress. Standards for portable electric spas and commercial hot food holding cabinets were adopted in December 2022. NYSERDA is evaluating potential standards for portable light fixtures. See NY Ad. Code Title 21, Section 509.

- AEEES 2005 adds new Energy Law § 16-106(2)(c)
The AEEES instructs the Secretary of State, in consultation with the president of NYSERDA, to establish energy efficiency performance standards for new manufacturing of the following kinds of products:
(o) portable light fixtures
(p) bottle-type water dispensers
(q) commercial hot food holding cabinets
(r) portable electric spas
(s) residential pool pumps
Currently, (s) residential pool pumps are preempted by federal law. (o) portable light fixtures, (p) bottle-type water dispensers, (q) commercial hot food holding cabinets, (r) portable electric spas are not preempted, and thus within the Secretary’s power on which products to establish standards. Statutory Language:
Energy Law § 16-106(2)(c): “On or before December thirty-first, two thousand ten, the secretary, in consultation with the president, shall adopt regulations in accordance with the provisions of this article establishing: (i) energy efficiency performance standards for new products of the types set forth in paragraphs (o) through (s) of subdivision one of section 16-104 of this article; (ii) procedures for testing the energy efficiency of the products covered by paragraphs (o) through (s) of subdivision one of section 16-104 of this article; (iii) procedures for manufacturers to certify that products covered by paragraphs (o) through (s) of subdivision one of section 16-104 of this article meet the energy efficiency standards promulgated under this article; and (iv) such further matters as are necessary to insure the proper implementation and enforcement of the provisions of this article with respect to the products covered by paragraphs (o) through (s) of subdivision one of section 16-104 of this article."
