On April 3, 2026, the USDA issued a Final Rule which adopted in full, without changes, its earlier Interim Final Rule that amended and removed portions of the agency's NEPA regulations. The USDA relied on the same three reasons: the rescission of implementing NEPA regulations by CEQ; Congressional amendments to NEPA in 2023; and the Supreme Court's recent decision in Seven County Infrastructure Coalition v. Eagle County, Colorado. 91 Fed. Reg. 17062 (Apr. 3, 2026).
