On March 7, 2025, the Department of Transportation issued a memorandum rescinding Biden-era guidance to states on the FHWA’s priorities for spending Infrastructure Investment and Jobs Act funds. The now-cancelled guidance, last updated February 24, 2023, acknowledged that “States are ultimately responsible for deciding how their formula and allocated funding is prioritized,” but noted that FHWA supported goals of addressing environmental impacts like greenhouse gas emissions, prioritizing infrastructure resilient to climate change, making room for electric vehicle infrastructure, and “reflecting the inclusion of disadvantaged and under-represented groups in the planning, project selection, and design process.”
In a statement announcing the Department’s action to rescind that guidance, Secretary Duffy indicated that “[t]he previous administration flouted Congress in an attempt to push a radical social and environmental agenda on the American people. This was an act of federal overreach.”
