EPA Proposes Reconsideration of the Good Neighbor Plan for Eight States

EPA proposed a phase 1 reconsideration of the Biden-era “Good Neighbor Plan,” which addressed the obligations of upwind states under the 2015 eight-hour ozone National Ambient Air Quality Standards to reduce ozone-forming pollutants like nitrogen oxides. Under the new proposal, the EPA would approve State Implementation Plans submitted by Alabama, Arizona, Kentucky, Minnesota, Mississippi, Nevada, New Mexico, and Tennessee, relieving them of obligations under the Good Neighbor Plan. Ozone is a potent greenhouse gas and major public health pollutant.
