DOI Announces Major Rescission of NEPA Regulations

On February 23, 2026, the Department of the Interior announced a major reform of its NEPA regulations. The DOI published the new final rule the following day, which rescinds over 80% of its previous NEPA regulations. Among other things, the final rule removes the requirement for direct, indirect, and cumulative impact analyses and would accelerate most project approvals. 91 Fed. Reg. 8738 (Feb. 24, 2026). The DOI's policies regarding NEPA are now published in a handbook available on the agency's website rather than via rule-making. The DOI's final rule was published following CEQ's previous rescission of its own NEPA regulations.
