On October 22, 2026, President Trump issued a Presidential Determination pursuant to Section 303 of the Defense Production Act of 1950 and relating to Executive Order 14156 (Declaring a National Energy Emergency), issued on January 20, 2025.
The new Determination addresses regulatory barriers to petroleum production. Pursuant to 50 U.S.C. § 4533(a)(7), the Determination waives the requirements of § 4533(a)(1)-(a)(6) for the purposes of expanding production capacity. The Determination will have the effect of increasing fossil fuel production and, as a consequence, greenhouse gas emissions.
