PHMSA announced limited enforcement of federal pipeline and hazardous-materials safety regulations and special permit guidance, pursuant to Executive Order 14156, “Declaring a National Energy Emergency.” DOT’s guidance states that it will refrain from enforcement if a regulated party demonstrates that a regulatory requirement would contribute to the purported national energy emergency, if the regulated party demonstrates that enforcement poses no significant environmental or public health risks, and if the regulated party applies for a special permit.
