FERC proposed to insert a conditional one-year sunset date into certain regulations, as a response to President Trump’s Executive Order on “Zero-Based Regulatory Budgeting to Unleash American Energy.” These amendments would cover rules pursuant to the Federal Power Act of 1935, the Natural Gas Act of 1938, and the Powerplant and Industrial Fuel Use Act of 1978—requiring the rules to be reviewed and reaffirmed, or expired.
