On May 18, 2023, the Environmental Protection Agency (EPA) published a proposed rule on coal ash disposal. The proposal is partially in response to a D.C. Circuit Court of Appeal’s order in Utility Solid Waste Activities Group v. EPA, remanding certain regulatory issues to EPA. It would revise certain disposal requirements.
