On May 8, 2024, EPA published a final rule on coal ash disposal. The rule is partially in response to a D.C. Circuit Court of Appeal’s order remanding certain regulatory issues to EPA. It also revises certain disposal requirements for new coal combustion residuals landfills and existing and new coal combustion residuals surface impoundments
