EPA Announces Final Disapproval of California’s Heavy-Duty Vehicle Rule for Out-of-State and Out-of-Country Vehicles

EPA announced its final disapproval of California’s Heavy-Duty Inspection and Maintenance Regulation under the Clean Air Act, for vehicles registered outside of California. EPA stated that California’s attempt to extend the regulation to vehicles passing through the state failed to provide necessary assurances under Section 110 of the CAA. Citing Dormant Commerce Clause concerns, EPA limited approval to in-state registered vehicles only.
