DOT Modifies FAA Grant Assurances, Removing References to EOs on Tackling the Climate Crisis and Environmental Justice

The Federal Aviation Administration (FAA) and Department of Transportation (DOT) modified Airport Improvement Program (AIP) grant assurances under the FAA Reauthorization Act of 2024, removing reference to Biden-era executive orders on topics including: Environmental Justice (EO 12898), Advancing Racial Equity and Support for Underserved Communities Through the Federal Government (EO 13985), and Tackling the Climate Crisis at Home and Abroad (EO 14008). In addition, the modified grant assurances mandate that airport owners/operator who made available any 100-octane low lead aviation gasoline (100LL) during calendar year 2022 cannot restrict or prohibit sale or self-fueling with 100-octane low lead aviation gasoline prior to 2031, or the reaching of industry consensus standard on the safe use, production, and distribution of unleaded aviation gasoline, “as determined appropriate by the Administrator.”
