DOI Adopts Categorical Exclusions under NEPA Section 109

On June 11, 2025, the Department of the Interior published a notice in the Federal Register that it has adopted 33 categorical exclusions (CEs) from the requirements of the National Environmental Policy Act (NEPA) that were previously established by other agencies, as authorized by NEPA section 109. The categorical exclusions include:

  • 5 CEs originating from the Federal Highway Administration
  • 4 CEs originating from the National Telecommunications Information Administration
  • 1 CE originating from the Presidio Trust
  • 6 CEs originating from the Tennessee Valley Authority
  • 2 CEs originating from the U.S. Department of Homeland Security
  • 1 CE originating from the National Resource Conservation Service
  • 7 CEs originating from the U.S. Forest Service
  • 3 CEs originating from the Bureau of Land Management
  • 1 CE originating from the Bureau of Reclamation
  • 1 CE originating from the Office of Surface Mining Reclamation and Enforcement
  • 1 CE originating from the United States Fish and Wildlife Service
  • 1 CE originating from the United States Geological Survey
