DOE proposed inserting a sunset provision into 10 CFR Part 300, which implements DOE's Voluntary Greenhouse Gas Reporting Program, under which entities can voluntarily report GHG emissions and emissions-reduction actions. Currently, regulations governing this program remain in effect indefinitely absent a separate rulemaking to amend or rescind them. Under the proposed § 300.14, the program would automatically expire 365 days after the effective date of a final rule, unless DOE makes a written determination, following public comment on costs and benefits, that an extension (of up to five years) is warranted.
