Department of Energy Withdraws Determination that Certain Gas-Burning Products are Subject to Energy Conservation Standards

On March 13, 2025, the Department of Energy published a proposed rule to reverse the Department’s earlier determination that certain “miscellaneous gas products” are covered under the Energy Policy and Conservation Act. In a 2022 determination the Department had concluded that these products, decorative hearths and outdoor heaters, could be subject to energy conservation standards, but the Department had not completed setting those standards. The Department’s proposed rule notes that this step is being undertaken in response to President Trump’s “Unleashing American Energy” Executive Order.
